WeFoster LLC provides hosting and development services to their customers under the following Terms of Service. By creating an account and launching your community on our platform you are accepting these terms. WeFoster LLC reserves the right to modify these terms without notice.

The WeFoster Platform is a WordPress focused host/platform

Although we run in an environment where multiple various content management systems and frameworks could be used, our customers are currently only allowed to run websites based on the WordPress open source project and its derivatives.

Service-level Agreement

Currently we do not provide a SLA for any of our plans except for our Enterprise Plans. For all other plans we take performance and site availability extremely seriously, and take full responsibility to fix any server issues as fast as possible. If your community is affected by downtime Subscriber may request compensation, in the form of free hosting credits, for the period of time that Subscriber’s site was affected.

Free hosting credit requests must be made via email to [email protected] within one week of the outage period being claimed. All such requests will be assessed and awarded on a per-case basis. WeFoster does not claim any responsibility nor offers any guarantees for Acceptable Downtime.

“Acceptable Downtime” means:

  • Scheduled outages or Force Majeure events
  • Downtime caused by a non-standard environment, Customer machine access, Customer’s violation of the WeFoster Terms of Service, Customer authored code or changes to the Site or Services by parties other than WeFoster, or use that exceeds Customer’s plan capacity (e.g. visitors that exceed the limit for the Customer’s plan)
  • Emergency maintenance (e.g. in order to apply a patch to address a security vulnerability)
  • Scheduled maintenance performed between the hours of 10 p.m. and 5 a.m. EST (Eastern Standard Time)

Abuse, Spam, Porn, etc.

You are not allowed to use the WeFoster platform for spam, abuse, pornography and other activities illegal in the United States. WeFoster LLC is not responsible for any content hosted on our customer’s sites unless explicitly uploaded by a WeFoster employee. You are not allowed to host copyrighted content. Any incoming DMCA request will be forwarded to the e-mail address associated with your account and you’ll be given five days to comply with the request or file a counter-request.

Non-US government requests will also be forwarded to the e-mail address on file, however, you reserve the right to not comply with such requests at your own risk.

Payment & Refund Policy

WeFoster offers different levels of service. By signing up for a particular level of service, you agree to pay WeFoster the applicable subscription fees. Unless you notify us before the end of your subscription period that you no longer wish to retain the services of WeFoster, your subscription will renew automatically. If we change pricing for a service to which you’re subscribed, we will notify you before your subscription is set to renew. You authorize us to charge any then-applicable fees to your credit card or other payment method we have on file for you. We offer refunds up to thirty (30) days after payment. Payment failures will result in the cancellation of your WeFoster plan.

All payments on WeFoster.co and WeFoster-Platform.co are processed by a third-party and we never store your credit card information. WeFoster offers payment via Stripe and PayPal.

WeFoster LLC offers a refund policy for new customers only. If you are unhappy with the WeFoster Platform service within 14 days after account activation, you may contact support to request a refund.

Refunds may be provided for up to seven (7) days after initial payment is made. No refunds are provided after fourteen (14) days following your initial sign-up to the free trial.

Account Suspension

WeFoster LLC reserves the right to suspend accounts in the event of a violation of the Terms of Service. The most recent account backup is kept for a maximum of 28 days. Please contact support for access to account backups.

Cancellation

If you cancel your subscription to WeFoster, we will queue your backed-up WeFoster Content for deletion. WeFoster will maintain a backup of your site for twenty-eight (28) days. Once this time has elapsed, WeFoster makes no guarantees that you will be able to restore or access any backup files of your website.

Limitation of Liability

Limitation of Liability. Subscriber acknowledges that in no event will WeFoster, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) any damages arising from such causes beyond the direct and exclusive control of WeFoster. Subscriber further acknowledges that WeFoster’s liability for its own negligence may not, in any event, exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred.

WeFoster shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law. If Subscriber site hosted on WeFoster is in the need for servicing, repair, or correction of equipment or data, Subscriber assumes any costs thereof.

Acceptable Conduct

Subscriber claims responsibility for the actions of all users of Subscriber’s account and any data that is created, stored, displayed by, or transmitted by Subscriber’s account while using WeFoster. Subscriber agrees to not engage in any activity that interferes with or disrupts WeFoster’s services or networks connected to any of our services.

All information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials, whether publicly posted or privately transmitted (“Content”), are the sole responsibility of the person from whom such Content originated. Subscriber, and not WeFoster, agrees to claim full responsibility for all Content uploaded, posted, emailed, transmitted or otherwise made available by Subscriber. WeFoster does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will WeFoster be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

Any and all of the content presented on WeFoster is, unless explicitly stated otherwise, subject to a copyright held by WeFoster. It is permissible to link to content from this site as long as the original source is clearly stated, but the wholesale reproduction or partial modification of content is not permitted. Exceptions are granted only if you receive prior written consent from WeFoster.
